Class Action Lawsuit
3 Kids Mine
Dust and Airborne Debris

Three Kids Mine Community Investigation
Assured Law is currently investigating concerns raised by homeowners and residents living near the Three Kids Mine site in Henderson.
Public reports related to the project recognize that dust generated from the site may travel beyond the property, especially during higher wind conditions. This has become a growing concern for nearby neighborhoods.

During a review of site activity from mid-January 2026, records show ongoing heavy construction work, including excavation, hauling of materials. These activities are the types of work that can generate significant dust..

Where testing was performed, certain materials commonly associated with industrial dust, including manganese, arsenic, and lead, were detected at the site’s perimeter. While the project reports state these levels did not exceed their internal limits, the presence of these materials in airborne dust is still an important issue being evaluated. Wind conditions during this same period were frequently reported as coming from the south and southwest, with stronger gusts on certain days, conditions that may carry dust toward nearby residential areas.
These findings do not mean that liability has been established or that any specific health condition has been caused. However, they do raise legitimate questions about how dust is being managed and monitored during active construction. In addition, separate environmental reports confirm that certain hazardous materials, including asbestos-containing debris, exist in various areas of the site and must be carefully handled and controlled during ground-disturbing activities.
